LAWASIA is a regional organization for lawyers' associations in the Asia-Pacific. The LAWASIA Human Rights Conference is a recurring event that brings together legal professionals to discuss and strategize on pressing human rights issues facing the region.

The Nepal Bar Association (NBA) has a significant presence in LAWASIA activities. The NBA proposes to host the 5th LAWASIA Human Rights Conference in Kathmandu, Nepal, from February 14-16, 2025.

This event will bring together legal professionals from across the Asia-Pacific region to explore the critical intersection of human rights and environmental issues, share best practices, and advocate for solutions that safeguard both human rights and the environment.

Human Rights Conference in Nepal: Key Rationale

In Nepal, the concept of rule of law and the independence of the judiciary are enshrined in the constitution, but their practical application remains complex. This complexity directly impacts the human rights situation in the country. The 2015 Constitution of Nepal, with its guarantees of rule of law and judicial independence, lays a strong foundation for the protection of human rights. An impartial and independent judiciary is essential for upholding human rights.

Nepal has the potential for a strong rule of law and an independent judiciary, which are cornerstones for a society that respects human rights. Strengthening judicial institutions, ensuring transparency in appointments, and addressing public concerns are all crucial steps forward. By building a robust legal system, Nepal can create an environment where human rights are protected, and all citizens have access to justice.

However, despite these constitutional safeguards, allegations of political interference in judicial appointments and case decisions continue. Political pressure on judges can lead to rulings that undermine human rights protections. Limited resources within the judiciary, such as a shortage of judges and inadequate infrastructure, can cause significant delays in processing human rights cases.

Nepal’s recent history offers a wealth of experiences relevant to human rights. By hosting the conference, Nepal can showcase its progress in human rights advancements while drawing attention to ongoing challenges. The conference would elevate the profile of Nepali lawyers, offering them a platform to engage with international colleagues and contribute their expertise on human rights issues specific to the region.
